Terms of business

The short version: we are not quantity surveyors, our figures are estimates, and you must check them and take responsibility for using them.

1. Who we are and what we are not

  1. Measured & Priced is a trading name of Craig Fearn ("we", "us"). We prepare cost estimates, materials schedules and cost plans from drawings the client supplies.
  2. We are not quantity surveyors. We are not chartered, not members of the RICS and not regulated by it. Nothing we supply is a quantity surveyor's cost plan, valuation, certificate, report or advice.
  3. The client must not describe our work to anyone as a quantity surveyor's work or as RICS work.

2. What the client gets

  1. An estimate prepared from the drawings and information the client supplies, for budgeting and design decisions only.
  2. Quantities measured from those drawings, and material prices taken from merchants' published web prices on the date stated in the document.
  3. Labour, where included, taken only from rates or quotes the client or their builder gives us.

3. The client checks and stands behind the figures

  1. The client must check every quantity, price, assumption and exclusion before relying on, sharing or acting on any document we supply.
  2. Once the client relies on, shares or acts on our documents, the client adopts them as their own and is responsible for that use, including any use by people they share them with.
  3. The client must get advice from a chartered quantity surveyor or other qualified professional for anything a lender, insurer, funder, tender, contract, valuation or legal process relies on.
  4. The client must tell us of any error they find within 14 days of delivery. We will correct errors in our own measurement or arithmetic free of charge.

4. Limits of the estimate

  1. Estimates are only as complete and accurate as the drawings and information supplied. Anything not shown, wrongly scaled, or changed after we start is not included.
  2. Prices change. Web prices are not quotes and are not trade prices. We do not guarantee any price will be available.
  3. Unless the document says otherwise, estimates exclude labour, plant, preliminaries, professional fees, contingency, site conditions, statutory charges and inflation.
  4. Low, mid and high figures are a range for budgeting, not a promise that the final cost will fall inside it.

5. Liability

  1. Our total liability for any claim connected with an order is limited to the fee paid for that order.
  2. We are not liable for loss of profit, loss of contract, delay, financing costs, or any indirect or consequential loss.
  3. We are not liable for any loss arising from the client's failure to check our documents as required by clause 3, or from use by anyone other than the client.
  4. Nothing in these terms limits liability that cannot legally be limited, or the statutory rights of a consumer.

6. Orders, fees and delivery

  1. An enquiry is not an order. We first confirm that the drawings are complete and give a fixed price. The order is made when the client pays through Stripe, and paying is acceptance of these terms.
  2. Prices are set by the floor area of the work, the service and the published complexity adjustments. If the drawings show a materially different area or complexity from the enquiry, we confirm the corrected price before you pay.
  3. Payment is in full, by card through Stripe, before we start. Stripe processes the payment; we never see card details. The price we confirm is the total price.
  4. Prepaid credit is usable on any job for 12 months from purchase and is not refundable once used. Monthly credit is a card subscription the client can cancel at any time, effective before the next payment; unused monthly credit carries over one month only.
  5. Delivery times run from payment and receipt of complete drawings, whichever is later.
  6. One revision is included in the full cost plan only. Further revisions are quoted separately.
  7. If you are a consumer, you may cancel within 14 days of accepting our price. If you ask us to start within those 14 days and then cancel, you pay for work already done; once the work is complete you can no longer cancel.

7. Use of documents

  1. The client may use our documents for their own project only. Third parties may not rely on them.
  2. Every document carries a "Read before use" statement. The client must not remove or edit it.

8. General

  1. These terms, our price confirmation and the client's acceptance are the whole agreement.
  2. These terms are governed by the law of England and Wales.
